Why a Draper office matters
Draper is at the seam between Salt Lake County and Utah County. That puts most of the south valley within a short drive: Sandy and South Jordan are roughly 10 minutes away without traffic, West Jordan about 15, and downtown Salt Lake City about 25. Lehi and the Point of the Mountain are on the other side of the I-15 Technology Corridor.
Being close matters for practical reasons. We can meet you, look at a crash site, photograph a hazard before it is fixed, or pick up records without turning a simple task into a day trip. If you can’t come to us because of your injuries, ask about meeting where it is easier for you.
How Utah injury law works, in plain terms
Deadline. Most Utah negligence claims must be filed within four years of the injury (Utah Code § 78B-2-307). Wrongful death claims generally have two years (§ 78B-2-304), and claims against a government entity require a written notice of claim within one year under the Governmental Immunity Act (§ 63G-7-402), with the lawsuit itself generally due within two years (§ 78B-2-304). Every one of these has exceptions, so do not rely on the general rule for your case.
Shared fault. Utah uses modified comparative fault. You can recover from the other side only if their fault exceeds yours, and your recovery is reduced by your share (§ 78B-5-818). If you are found 50% or more at fault, you recover nothing. That is why insurers often argue about fault percentages as hard as they argue about medical bills.
No-fault first. Utah requires personal injury protection (PIP) coverage on auto policies, which pays some medical bills and lost wages regardless of fault. To claim general damages such as pain and suffering from the at-fault driver, you generally need to meet a threshold: more than $3,000 in medical expenses, a bone fracture, permanent disability or impairment, permanent disfigurement, dismemberment, or death (§ 31A-22-309). We help clients use PIP correctly so it does not hurt the larger claim.
Where Utah cases are filed
Injury lawsuits in Salt Lake County go to the Third Judicial District Court, which hears cases at the Scott M. Matheson Courthouse (450 S State St, Salt Lake City) and at the West Jordan courthouse (8080 S Redwood Rd). Utah County cases go to the Fourth Judicial District Court, which has courthouses in Provo (137 N Freedom Blvd) and American Fork (75 E 80 N). Most cases settle without a trial, but we prepare every file as if it may be filed.
