Here’s what happens next

Nothing replaces the person you lost. A wrongful death claim can hold the responsible party accountable and help cover the financial losses that follow: funeral costs, lost income and support, and the loss of companionship and guidance.

We handle the process gently and explain each step before it happens, so your family can focus on each other.

Injuries we see

Wrongful death claims arise from car, truck and motorcycle crashes, pedestrian collisions, unsafe premises, and other negligence. The damages a family may recover can include funeral and burial costs, lost financial support and services, and the loss of love, companionship and guidance. Which damages apply depends on state law and the family’s circumstances.

Who can bring the claim

In Utah, wrongful death claims are generally brought by the decedent’s heirs or the personal representative of the estate. In Arizona, the action is brought by the surviving spouse, child, parent or guardian, or the personal representative, on behalf of the statutory beneficiaries (A.R.S. § 12-612). Arizona’s wrongful death statute applies when the death was caused by a wrongful act, neglect or default that would have given the injured person a claim (A.R.S. § 12-611).

Families sometimes disagree about who should bring the case. We explain the rules and help the family move forward together.

Utah law

Utah generally allows two years from the date of death to bring a wrongful death action (Utah Code § 78B-2-304). Claims involving a government entity require a notice of claim within one year (§ 63G-7-402). Utah’s modified comparative fault rule (§ 78B-5-818) also applies.

Arizona law

Arizona generally allows two years, measured from the date of death (A.R.S. § 12-542). Claims against a public entity require a notice of claim within 180 days and a lawsuit within one year (A.R.S. §§ 12-821.01, 12-821). Pure comparative fault applies (A.R.S. § 12-2505).

How Now Injury Law handles your case

You get a named case manager and a standing response window. When you call, someone picks up. When there’s news, good or bad, you hear it from us first. We get you in front of the right providers quickly, because delayed treatment hurts both your recovery and your claim, and we’ll tell you when treatment is enough.

We handle the letters to the insurance companies, the records requests and the negotiation. If an insurer won’t be reasonable, we’re prepared to file and try the case. Se habla español: our bilingual case managers Jacqueline, Janely and Noelidia work with Spanish-speaking clients in both states.

What to do after

  1. Request copies of the police or incident report and the death certificate.
  2. Keep funeral and medical bills.
  3. Don’t give statements to insurers or sign documents before talking to us.
  4. Gather information about the decedent’s income and household contributions.
  5. Call us early, because deadlines are shorter than for injury claims.

Damages, and the math on your settlement

That’s a fair question: what can be recovered? Economic damages include medical bills (past and future), lost wages, reduced earning capacity, rehabilitation, and property damage. Non-economic damages include pain and suffering, emotional distress, and loss of enjoyment of life. Every case is different, and we will never promise you a number.

We tell you when treatment is enough. Running up medical bills does not make a claim stronger, and we will never grow your medical bills to grow our fee. Before you decide on any offer, we show you the math in writing: the gross amount, fees, costs, liens, and what you keep.

Questions

Frequently asked

How long do we have to file?

Generally two years from the date of death in both Utah and Arizona, and shorter when a government entity is involved.

Who receives the recovery?

It depends on state law and the family members involved. We explain who the beneficiaries are before anything is filed.

Does a criminal case affect a wrongful death claim?

They are separate. A civil claim can proceed regardless of criminal charges, though the criminal case may affect timing and evidence.

What does it cost?

Free consultation — you owe nothing unless we win.
