Compact city, busy corridors

Midvale is small in area but sits on some of the valley’s busiest routes. I-15 runs through the city with interchanges at 7200 South and nearby 9000 South, State Street and 700 East carry north–south traffic, and Fort Union Boulevard and 7800 South run east–west. TRAX lines and several stations bring frequent rail crossings and pedestrian traffic.

Dense apartments and commercial areas around the stations mean pedestrian and cyclist injuries are a real concern, as are rear-end and turning crashes on State Street and Fort Union Boulevard.

If you were a pedestrian or rider

Pedestrians and cyclists hit by cars often have serious injuries even at moderate speeds. In Utah, your own auto policy’s PIP coverage may pay early medical bills even though you were on foot, and uninsured or underinsured motorist coverage may help if the driver had little or no insurance.

Get the driver’s information and the police report number. Note the location of any station or business cameras, and call us so we can request footage before it is gone.

Renters and apartment injuries

Midvale has many apartment communities near its transit stations. If you were hurt by a broken stair, poor lighting, an icy walkway or an unsecured gate at a complex, the property owner or management company may be responsible if they knew or should have known about the hazard. Report the problem in writing, photograph it before it is fixed, and keep copies of any maintenance requests you made earlier.

What the law means for your claim

Utah generally allows four years to file a negligence claim (Utah Code § 78B-2-307), two years for wrongful death (§ 78B-2-304), and only one year to file a notice of claim when a government entity is involved (§ 63G-7-402). Under Utah’s modified comparative fault rule, you can recover only if the other side’s fault exceeds yours, and your recovery is reduced by your share (§ 78B-5-818). At 50% you recover nothing.

If a Midvale case has to be filed, it goes to the Third Judicial District Court, which hears Salt Lake County cases at the Matheson Courthouse (450 S State St) and the West Jordan courthouse (8080 S Redwood Rd). Most claims settle without a trial, but we build every file so it is ready if one is needed.
