A crossroads city

Tempe is bordered and crossed by I-10, the Superstition Freeway (US-60), the Loop 101 and the Loop 202 (Red Mountain). Its interchanges see constant merging traffic. Arizona State University sits next to downtown Mill Avenue, and Valley Metro light rail and the Tempe Streetcar run through the area.

Students, cyclists, scooter riders and pedestrians share the road with heavy traffic. Many Tempe injuries happen to people who were not in a car at all, and those claims often depend on the driver’s insurance and the injured person’s own uninsured/underinsured motorist coverage.

Scooters, bikes and pedestrians

If you were hurt on a bike or scooter, keep the device, take photos of it and of the scene, and save any app records showing your ride. If a hazard in the road or sidewalk caused the fall, a city or property owner may be involved. Arizona’s 180-day notice-of-claim rule applies to claims against public entities.

Under Arizona’s pure comparative fault rule, being partly at fault, for example riding outside a bike lane, reduces but does not end your claim.

How we work with students and young adults

Many Tempe clients are students or young professionals who have never dealt with an insurance claim. We explain each step in plain language, coordinate with campus or student health insurance where relevant, and handle the adjusters so you can focus on recovering and on school or work. Your case manager has a standing response window, so you always know when you will hear back.

What the law means for your claim

Arizona’s general deadline for injury claims is two years (A.R.S. § 12-542). If a city, county or state entity is involved, a notice of claim is due within 180 days and the lawsuit within one year (A.R.S. §§ 12-821.01, 12-821). Arizona uses pure comparative fault (A.R.S. § 12-2505), so your recovery is reduced by your share of fault but not eliminated by it.

Lawsuits are filed in the Maricopa County Superior Court, whose main courthouses are on Jefferson Street in downtown Phoenix, a few minutes from our office. Most claims resolve through negotiation, but we prepare each case as though it could be tried.
