Scottsdale traffic, visitors and events

Scottsdale stretches a long way north to south. The Loop 101 (Pima Freeway) curves through the city, and Scottsdale Road, Hayden Road and Pima Road are its main north–south arterials. Old Town, resorts, spring training and major annual events bring visitors who don’t know the roads.

Common crash patterns include rear-end collisions on Scottsdale Road, impaired-driving crashes on nights and weekends, and pedestrian injuries in Old Town. A crash with a rental car or out-of-state driver can involve several insurance policies and coverage questions.

Care and next steps

HonorHealth operates major hospitals in Scottsdale, including the Scottsdale Osborn Medical Center. Get evaluated promptly and keep every record. If alcohol may have been involved, tell the police at the scene. Impairment evidence is collected right away or not at all.

Get the report number from Scottsdale Police, or from DPS for freeway crashes. Collect witness names, and avoid discussing fault. Then call us before talking to the other insurer.

Rideshare and nightlife crashes

Old Town Scottsdale sees heavy rideshare traffic, especially at night. If you were hurt as a rideshare passenger, or by a rideshare driver, the coverage available depends on what the driver was doing at the time: waiting for a ride request, heading to a pickup, or carrying a passenger. Screenshots of the app and your trip receipt help establish that. We identify which policy applies and pursue it.

What the law means for your claim

Arizona’s general deadline for injury claims is two years (A.R.S. § 12-542). If a city, county or state entity is involved, a notice of claim is due within 180 days and the lawsuit within one year (A.R.S. §§ 12-821.01, 12-821). Arizona uses pure comparative fault (A.R.S. § 12-2505), so your recovery is reduced by your share of fault but not eliminated by it.

Lawsuits are filed in the Maricopa County Superior Court, whose main courthouses are on Jefferson Street in downtown Phoenix, a few minutes from our office. Most claims resolve through negotiation, but we prepare each case as though it could be tried.

Questions

The other driver was a tourist with a rental car. Who pays?

Usually the driver’s own policy, and sometimes coverage through the rental. Your own uninsured/underinsured motorist coverage may also apply. We sort out the order.

I think the other driver was drunk. Does that change my case?

It can affect liability and, in some cases, the damages available. Make sure police know at the scene.

How far is your office?

About 10 miles, roughly 18 minutes without traffic.

What does it cost to talk to you?

Nothing. We work on contingency: no attorney’s fees unless we recover compensation for you.
