Gilbert roads and growth
Gilbert is one of the largest towns in the country. The Superstition Freeway (US-60) runs along its north side, and the Loop 202 Santan Freeway crosses its southern half. Gilbert Road, Val Vista Drive, Higley Road and Power Road are wide arterials with high speeds and frequent left turns.
Rapid growth has brought construction zones and new intersections. Crashes on six-lane arterials, including left-turn collisions, red-light crashes and rear-end collisions, can cause serious injuries even within town limits.
Family neighborhoods
Gilbert has many schools, parks and canal paths, so pedestrian and bicycle injuries involving children are a particular concern. Claims for minors have their own procedures, and settlements may require court approval, so get advice before signing a release.
Banner Gateway Medical Center and Mercy Gilbert Medical Center are both in Gilbert. Keep every bill and record, along with your own notes on how the injury affects your day.
Uninsured and underinsured drivers
Arizona is an at-fault state, so the other driver’s liability insurance is usually the first source of payment. If that driver has no insurance or only a small policy, your own uninsured or underinsured motorist coverage may make up the difference. We review your policy with you, because many people don’t know what they carry until they need it.
What the law means for your claim
Arizona’s general deadline for injury claims is two years (A.R.S. § 12-542). If a city, county or state entity is involved, a notice of claim is due within 180 days and the lawsuit within one year (A.R.S. §§ 12-821.01, 12-821). Arizona uses pure comparative fault (A.R.S. § 12-2505), so your recovery is reduced by your share of fault but not eliminated by it.
Lawsuits are filed in the Maricopa County Superior Court, whose main courthouses are on Jefferson Street in downtown Phoenix, a few minutes from our office. Most claims resolve through negotiation, but we prepare each case as though it could be tried.
